DMCA policy

How to report claimed copyright infringement on Rebasely, and how to answer a report.

Designated agent

Rebasely's agent for notices of claimed infringement under the Digital Millennium Copyright Act (17 U.S.C. 512) is:

Sending a notice

Email dmca@rebasely.com with:

  1. your physical or electronic signature, as the copyright owner or someone authorized to act for them;
  2. the copyrighted work you believe is infringed (or a list, if several are covered by one notice);
  3. the material you believe infringes, with the Rebasely address of each repository or file, so we can find it;
  4. your name, postal address, telephone number and email address;
  5. a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law;
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.

A notice that leaves out one of these may not be acted on. Knowingly misrepresenting that material infringes can make you liable for damages (17 U.S.C. 512(f)). Consider whether the use may be fair use before you send a notice.

What Rebasely does with a notice

  1. We check that the notice has every element above.
  2. We make the repository that holds it private, so only its members can reach it (Rebasely cannot remove single files from a repository's history), and tell the organization's owners, with a copy of the notice.
  3. The owners can remove the material themselves, or send a counter-notice if they believe it was removed by mistake.

Sending a counter-notice

If your material was disabled and you believe that was a mistake or a misidentification, email dmca@rebasely.com with:

  1. your physical or electronic signature;
  2. the material that was disabled and the Rebasely address where it was before;
  3. a statement under penalty of perjury that you have a good faith belief that the material was disabled as a result of mistake or misidentification;
  4. your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, outside the United States, any judicial district in which Rebasely may be found), and that you will accept service of process from the person who sent the notice or their agent.

We send the counter-notice to the person who sent the notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we restore the material 10 to 14 business days after we received the counter-notice.

Repeat infringers

An account is a repeat infringer when Rebasely has removed or disabled its content in response to 3 or more valid copyright notices within 12 months, not counting notices that a counter-notice answered and that were not followed by a lawsuit. Rebasely terminates the accounts of repeat infringers, and may terminate an account sooner for clear, deliberate infringement.
